Big Win for Indiana: Finally, Some Common Sense Laws for Hemp Products

We just got some great news, and I mean finally. After years of chaos and confusion around Delta 8 THC and other low-THC hemp products, Indiana lawmakers are stepping up and doing the right thing. Senate Bill 478 is on track to become law, and as someone who’s been in this industry since the early days, let me tell you—this is a huge win. Not just for us as responsible retailers, but for the safety of all Hoosiers.

Back in 2019, when 3Chi brought us one of the first Delta 8 carts, I couldn’t believe it was even legal. I kept asking, “How is this legal?” But it was. And it still is. And that’s not a bad thing—as long as it's sold safely, responsibly, and only to adults in a certified and educated environment. That’s what Senate Bill 478 is all about. And that’s why we support it 100%.

What Senate Bill 478 Actually Does

This bill isn’t about banning hemp. It’s about regulating it so people—especially our most vulnerable—stay safe. Here's what it changes:

  • Retailers must be certified and registered with the Indiana Tobacco and Alcohol Commission (finally).
  • Minimum age is now 21 to buy or even enter a store that sells THC products.
  • Stores can’t be near schools. Common sense.
  • Gas stations and convenience stores? Out. No more buying hemp at the same place you get hot dogs and scratch-offs.
  • No more free THC samples at farmers markets. You’ve got to be a licensed hemp retailer, not handing out THC where you’re buying tomatoes.
  • Child-proof packaging becomes a legal requirement.
  • Only legitimate hemp retailers can participate. This isn’t a free-for-all anymore.

These are rules we’ve followed from Day One at Humanity Health CBD. Not because we had to—but because we believe in doing this the right way.

Why This Matters for Indiana

There’s a lot of talk about keeping kids safe. And yes, of course we should. But you know who else needs protection? Seniors. People in their 60s, 70s, 80s—folks who are done with prescription pills and looking for natural ways to manage pain, anxiety, and sleep. These are the people who want to enjoy retirement, spend time with grandkids, and feel like themselves again. They deserve access to safe, regulated, trustworthy hemp products too.

And let’s not forget about the 25 to 55 crowd. They’re working full-time, raising families, stressed out and overwhelmed. But they don’t have time to research the difference between real education and the nonsense floating around online. This bill helps clear out the noise and keeps the industry honest—for them too.

What Still Needs Work

One thing that still hasn’t changed? Craft hemp flower is still illegal in Indiana. Always has been since 2019, and this bill doesn’t change that. You’ll still see it out there in gas stations and smoke shops—sold under the radar—but it’s not legal. And it makes all of us look bad.

We want that law changed. Let’s support Indiana’s hemp farmers by pushing for a legal framework for high-quality, craft flower next. But we can’t get there without first cleaning up the mess—and SB 478 is that cleanup.
